A successful business executive divorced his wife and fell in love with another woman. Unhappy and jealous, the former wife went to police and claimed that our client sexually molested her child from another marriage. The mother coached the child to tell a sordid tale, and when interviewed by the police, the child performed exactly as her mother had instructed. Our client was charged with the heinous crime of sexual assault on a child. The penalty is life imprisonment. Our investigation uncovered a long history of disreputable conduct on the part of the former wife, including a lengthy criminal record, a pattern of reporting unfounded and false allegations against our client, and parental misconduct resulting in social services revoking custody of her child for a time. Social services records further indicated that the child had been molested at a foster home. We presented these facts to the jury and after two hours of deliberation, they voted to acquit.
