	VICTORY IN DEPORTATION TRIAL
	An elderly woman went to Mexico for medical reasons. She had been a legal permanent resident (green card holder) for over twenty years. On the way back across the border, her car was stopped and searched. Unbeknown to her, a younger male passenger had secreted drugs in the side panels of the car. Innocent and unfamiliar with the legal system, she plead guilty to misprision of a felony (failure to report a crime) in federal court in Texas. Years later, the Department of Homeland Security decided to deport her for drug trafficking. I re-litigated the drug smuggling case and presented evidence showing that she had known nothing about the smuggling. Additional evidence from banking records showed there was no income from drug proceeds. Affidavits from doctors in the United States and Mexico verified the medical purpose of her trip to Mexico. Finally, family members, employers and an expert psychologist presented evidence that her deportation would create a tremendous hardship on her and her family. All charges were dismissed and her green card status was re-instated. She intends to remain in the United States for the rest of her life.
